Real Estate/Land Use
Living space and work space are essential components for individuals, businesses
and institutions. DeMoura | Smith attorneys are regularly called on by
their clients to assist them in legal matters relating to homes, offices,
buildings and land.
The Firm's real estate clients include developers, investors, REITs,
commercial and retail landlords and tenants, mortgage lenders, banks,
owners and developers of office buildings, shopping centers, and residential
projects. We have extensive experience representing clients in real estate
matters including purchase and sale agreements and leases, zoning, title,
mortgages, or condominium matters, and due diligence.
Our real estate practice also encompasses real estate litigation. We represent
clients in zoning appeals, landlord/tenant disputes, letters of intent
cases, actions to enforce contracts for sale, allegations of wrongful
foreclosure or lender liability, truth-in-lending suits and other mortgage-related
litigation. Recently, DeMoura | Smith's attorneys:
- Obtained summary judgment against claims that a landowner had promised
to sell his interests in a large waterfront parcel to a real estate developer;
- Successfully defended a national bank in federal court against claims brought
under the Massachusetts consumer protection act alleging unfair and deceptive
mortgage practices and obtained dismissal of the claims; and,
- Successfully opposed two proposed multi-family waterfront condominium developments
on behalf of an abutter.
The Firm's experienced advocates work with their clients to resolve
these important matters favorably and as efficiently as possible.
