Protecting your family, your home, and your personal assets are among the
most important and personal decisions in your life. DeMoura | Smith recognizes
this during each stage of the estate planning process. We take our role
seriously in this most important and personal engagement and we work collaboratively

We work closely with our clients and their families to preserve their assets,
assessing the tax and other legal implications regarding their estate
plans. We prepare wills, revocable and irrevocable trusts, durable powers-of-attorney
and health care proxies. We are also engaged to advise clients on succession
planning, Medicare planning, and asset protection. Our practice includes
probate of wills, administration of estates, representation of executors,
guardians and conservators.
On behalf of one of his clients, Attorney Kenneth DeMoura obtained the
first conservatorship and guardianship appointments issued by the Suffolk
County Probate and Family Court in Boston following the extensive overhaul
of the Massachusetts Uniform Probate Code effective in July 2009.
DeMoura | Smith has a track record of success representing clients in probate
litigation cases. DeMoura | Smith attorneys have successfully tried many
probate matters in the Massachusetts Probate and Family Court including
claims seeking damages for trustees' breach of fiduciary duty, claims
for accounting, and claims for removal of guardian. We have represented
parties in will contests, litigation involving the administration of trusts,
guardianship or conservatorship proceedings and claims by heirs. The Firm's
